2. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed via the Onitora Shop online store.

The version valid at the time of order placement shall apply.

By placing an order, the Customer confirms acceptance of these GTC.

3. Conclusion of Contract

3.1 Product listings do not constitute legally binding offers.

3.2 By placing an order and completing payment, the Customer submits a binding offer.

3.3 The contract is concluded upon written confirmation or dispatch of the goods.

3.4 Onitora Shop reserves the right to refuse or cancel orders in case of:

  • pricing errors
  • stock discrepancies
  • technical errors
  • suspected fraud or abuse
  • incorrect or incomplete customer information

4. Products

4.1 Onitora Shop sells authentic Trading Card Game (TCG) products.

4.2 Product descriptions and images are illustrative and may vary slightly.

4.3 Products are subject to availability.

4.4 Minor packaging imperfections do not constitute a defect.

4.5 Sealed products that have been opened, unsealed, or altered are excluded from any return or claim.

4.6 Onitora Shop reserves the right to limit quantities per customer and to cancel orders suspected of commercial resale, automated purchasing, or abusive behavior.

5. Prices

5.1 All prices are listed in CHF.

5.2 Prices include applicable Swiss VAT where required.

5.3 Shipping costs are calculated at checkout.

5.4 Free shipping applies to orders exceeding CHF 200.– within Switzerland.

5.5 The applicable price is the one displayed at the time of confirmed order placement.

5.6 Obvious pricing or system errors may be corrected prior to dispatch.

6. Payment

6.1 Accepted payment methods:

  • TWINT
  • Credit / Debit Cards
  • Bank Transfer
  • PayPal

6.2 For bank transfer payments:

  • Payment must be completed within 48 hours.
  • Proof of payment must be submitted by email within 48 hours.
  • Orders not paid within this timeframe may be cancelled without notice.

6.3 Orders are secured only after confirmed payment.

6.4 Onitora Shop reserves the right to cancel orders in case of chargebacks, payment disputes, or suspected fraudulent activity.

7. Delivery

7.1 Orders are shipped from Switzerland via Swiss Post.

7.2 Customers may select:

  • B-Post (approx. 2–3 business days)
  • A-Post (approx. 1–2 business days)

7.3 Delivery times are estimates and not guaranteed.

7.4 Risk transfers to the Customer upon delivery of the goods. If the Customer selects a specific carrier different from the standard shipping method offered by Onitora Shop, risk transfers upon handover to that carrier.

7.5 Onitora Shop is not liable for delays caused by postal services or circumstances beyond its control.

8. Pre-Orders

8.1 Release dates are estimates provided by suppliers and may change.

8.2 Delays outside the reasonable control of Onitora Shop do not entitle the Customer to damages or cancellation.

8.3 Pre-orders are generally non-cancellable once confirmed.

8.4 If an exceptional cancellation is accepted, administrative fees of CHF 30.– apply.

9. Returns & Warranty

9.1 The Customer must inspect goods immediately upon receipt.

9.2 Any defect or shipping damage must be reported within 48 hours with photographic evidence.

9.3 If a defect is confirmed, Onitora Shop may at its discretion:

  • replace the product (if available), or
  • provide an appropriate remedy.

9.4 Claims for damages caused by improper handling, storage, or external factors are excluded.

9.5 Further claims are excluded to the extent permitted by Swiss law.

10. Cancellation Policy

10.1 In-stock orders may only be cancelled prior to dispatch.

10.2 If cancellation is exceptionally accepted, CHF 30.– administrative fees apply.

10.3 Swiss law does not provide a general right of withdrawal for online purchases unless expressly stated.

11. Purchase of Single Cards (Buyback)

11.1 Onitora Shop may purchase selected high-value collectible cards.

11.2 Offers are typically around 70% of current market value and depend on:

  • Condition
  • Market demand
  • Liquidity
  • Authenticity verification

11.3 Offers are non-binding until physical inspection.

11.4 Final payment may be adjusted if condition materially differs from the original representation.

12. Force Majeure

Onitora Shop shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Strikes
  • Supply chain disruptions
  • Postal interruptions
  • Governmental restrictions

13. Limitation of Liability

13.1 Liability is limited to foreseeable direct damages caused by intent or gross negligence.

13.2 Liability for indirect damages, loss of profit, loss of revenue, loss of data, or consequential damages is excluded.

13.3 Mandatory provisions of Swiss law remain unaffected.

14. Data Protection

14.1 Personal data is processed in accordance with the Swiss Federal Act on Data Protection (revDSG).

14.2 Data is used solely for order processing, customer service, and legal obligations.

14.3 Appropriate technical and organizational security measures are implemented.

15. Legal Capacity

By placing an order, the Customer confirms being at least 18 years old or legally authorized to enter into binding contracts.

16. Severability

If any provision of these GTC is invalid or unenforceable, the remaining provisions remain valid.

17. Governing Law & Jurisdiction

Swiss law applies exclusively.

The place of jurisdiction is Switzerland, at the registered place of business of Onitora Shop.
